1. Acceptance of Terms

By accessing or using BarFinder, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not use BarFinder. Use of BarFinder may also be subject to Apple’s applicable App Store terms and standard end-user license agreement.

2. The BarFinder Service

BarFinder provides features that may include:

• Discovery of outdoor fitness parks and calisthenics locations
• Park photos, equipment information, and community-submitted details
• Location-based park discovery
• Workout planning and exercise information
• Saved parks, workout templates, and favorite exercises
• User submissions of parks, photos, videos, and park-related information

Features may change, improve, or be discontinued over time.

3. Accounts

Some features require a BarFinder account. You are responsible for maintaining the security of your account and for providing accurate information where required. You may not impersonate another person or misuse another user’s account. BarFinder may suspend or terminate accounts used for abuse, fraud, unlawful activity, or violations of these Terms.

4. User-Generated Content

Users may submit content including park listings; park descriptions and information; photos; videos; crowd or condition reports; and other park-related information. Users retain ownership of content they submit.

By submitting content to BarFinder, you grant BarFinder a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, format, adapt, and otherwise use the submitted content as reasonably necessary to operate, improve, promote, and provide the BarFinder service. This license applies only for purposes connected with BarFinder and its related services.

This permission allows BarFinder to display submitted park photos and videos; publish approved park listings; resize, crop, compress, format, or technically modify media for display; moderate and review submissions; and display content across BarFinder’s app, website, and promotional materials related to the service.

5. Your Responsibility for Submitted Content

By submitting content, you represent that you own the content or have permission to submit it; it does not infringe another person’s copyright, trademark, privacy, publicity, or other rights; it is accurate to the best of your knowledge where it describes a park or location; it does not violate applicable law; and it does not contain malicious, abusive, threatening, hateful, sexually explicit, or otherwise prohibited material.

Do not upload photographs or videos that you do not have permission to share.

6. Content Moderation

BarFinder may review, approve, reject, edit for formatting, hide, or remove user-submitted content at its discretion when reasonably necessary to operate or protect the service.

Content may be removed if it violates these Terms or another person’s rights; is inaccurate, fraudulent, misleading, or spam; is threatening, abusive, hateful, obscene, or sexually explicit; creates safety concerns; is unrelated to BarFinder’s intended purpose; or violates applicable law.

BarFinder is not obligated to publish every submission.

7. Reporting Problems

If you encounter inappropriate, inaccurate, infringing, or abusive content, you may report it to BarFinder Support.

BarFinder may investigate reports and take appropriate action, including removing content or restricting accounts.

8. Prohibited Use

You may not upload illegal or infringing content; harass, threaten, abuse, or impersonate others; submit intentionally false park information; upload spam or malicious content; attempt to interfere with or compromise BarFinder systems; scrape or extract BarFinder data using automated methods without permission; attempt unauthorized access to another account; use BarFinder for unlawful purposes; or circumvent moderation, security, or account restrictions.

9. Park Information and Third-Party Locations

BarFinder provides information about parks and outdoor workout locations for convenience. Park conditions, equipment, operating hours, accessibility, availability, safety conditions, and other information may change. BarFinder does not own or operate most listed parks. You should verify important information and follow rules established by the park owner, municipality, property owner, or other responsible authority.

10. Fitness and Safety

BarFinder provides general fitness, exercise, and park-discovery information and is not a medical service. Exercise and outdoor physical activity involve risk of injury. You are responsible for determining whether a workout, exercise, park, or piece of equipment is appropriate for you. Inspect equipment and surroundings before use, exercise within your own abilities, and seek appropriate professional medical advice before beginning an exercise program if you have health concerns, injuries, or medical conditions.

11. Location and Navigation

Location, distance, travel time, mapping, and navigation information may be approximate and may depend on device location services and third-party mapping or navigation providers. You are responsible for following applicable traffic, park, property, and safety rules. BarFinder does not guarantee that every route, travel estimate, or location record is accurate or currently accessible.

12. BarFinder Intellectual Property

BarFinder branding, logos, app design, original graphics, software, interface elements, and original content are owned by BarFinder or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit BarFinder-owned materials without permission, except as permitted by applicable law.

13. Third-Party Services

BarFinder may rely on third-party platforms and services such as Apple platform services; mapping or navigation providers; and authentication, database, hosting, storage, and email infrastructure providers. Use of those services may also be subject to their respective terms and policies.

14. Suspension and Termination

BarFinder may suspend or terminate access when reasonably necessary for violations of these Terms, fraud or abuse, security concerns, illegal activity, repeated inappropriate submissions, or attempts to interfere with the service. You may stop using BarFinder at any time. You may request account deletion through the BarFinder application.

15. Disclaimer of Warranties

To the extent permitted by law, BarFinder is provided on an “as available” and “as is” basis. We do not make absolute guarantees regarding availability, the accuracy of park information, fitness outcomes, navigation accuracy, or error-free operation.

16. Limitation of Liability

To the maximum extent permitted by applicable law, BarFinder and its operators will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of the service. Nothing in these Terms limits liability where applicable law does not allow such limitation.

17. Changes to These Terms

BarFinder may update these Terms as the service evolves or legal requirements change. Material updates may be reflected by revising the Effective Date shown at the top of this page. Continued use of BarFinder after updated Terms become effective may constitute acceptance where permitted by law.

18. Governing Law

These Terms are governed by applicable law. Any mandatory rights available to users under the laws of their jurisdiction remain unaffected.
